Welcome to Forme Living Co.
Forme Living Co is operated by Arlo Living Home Pty Ltd. In these Terms of Service, “Forme Living Co”, “we”, “us” and “our” refer to Arlo Living Home Pty Ltd trading as Forme Living Co.
These Terms of Service apply when you visit our website, browse our store, place an order, purchase our products, create an account, contact us, or otherwise use our website, products, content, features, tools or services.
By accessing or using our website or placing an order with us, you agree to these Terms of Service, together with our Privacy Policy, Shipping Policy, Returns Policy, 30-Day Comfort Guarantee and Warranty.
If you do not agree to these Terms, please do not use our website or purchase from us.
Nothing in these Terms limits your rights under Australian Consumer Law.
1. Eligibility and account use
By using our website or placing an order, you confirm that you are at least the age of majority in your state or territory of residence, or that you have the consent of a parent or guardian.
You agree to provide accurate, current and complete information when creating an account, placing an order or contacting us. This includes your name, email address, billing details, payment details, delivery address and any other information reasonably required to process your order.
You are responsible for keeping your account login details secure and for all activity that occurs under your account. You must not transfer, sell, assign or allow another person to use your account without our permission.
2. Our products
We do our best to display our products as accurately as possible, including descriptions, images, colours, dimensions, materials and product details.
However, product colours, textures and finishes may appear differently depending on your screen, device settings, lighting and photography. Minor variations in colour, fabric, texture, dimensions, shape, finish or appearance may occur.
Because some Forme Living Co products are delivered compressed, minor wrinkles, creasing, softening, settling or shape variation after unboxing can be normal. Please allow up to 48 hours for compressed furniture to fully expand, settle and take shape.
Product descriptions, availability, pricing and specifications may change from time to time. We may update, discontinue or limit products at our discretion.
3. Orders
When you place an order with us, you are making an offer to purchase the products in your cart.
Your order is accepted when we confirm your order and receive or process your payment. We may accept, reject, cancel or limit an order where reasonably necessary, including where there is an error in pricing, product information, stock availability, shipping availability, suspected fraud, misuse of promotions, or an issue with your payment or delivery details.
If we need to cancel or change your order, we will contact you using the details provided at checkout.
Please review your order carefully before submitting it, including product selection, colour, size, quantity, delivery address and contact details.
Orders can be cancelled free of charge before they have been dispatched. Once an order has been dispatched, it can no longer be cancelled and the relevant returns process will apply.
Pre-orders may be cancelled for a full refund any time before dispatch. Once a pre-order has been dispatched, it can no longer be cancelled and the relevant returns process will apply.
4. Pricing, promotions and payment
All prices are listed in Australian dollars unless stated otherwise.
Prices include GST where applicable, unless otherwise stated. Delivery, shipping, handling or other charges may apply and will be shown at checkout where applicable.
Prices, discounts, promotions and offers may change at any time without notice. The price charged for a product will be the price shown at the time you place your order, subject to any pricing error or system error.
Promotions may be subject to separate terms and conditions. If promotion terms conflict with these Terms, the promotion terms will apply to that promotion.
You agree to provide current, complete and accurate payment information. You confirm that you are authorised to use the payment method provided and that your payment provider will honour the charges.
We may use third-party payment providers to process payments. Your use of those payment methods may also be subject to the provider’s own terms, policies and processing times.
5. Shipping and delivery
Shipping and delivery are governed by our Shipping Policy.
Delivery timeframes are estimates only and may vary depending on your location, courier availability, warehouse processing, public holidays, peak periods, weather events, access requirements or other circumstances outside our control.
We currently deliver within Australia only, where our delivery network allows. Some regional or remote postcodes may not be serviceable.
Our standard delivery service is to your front door or ground floor entry point unless otherwise arranged. Delivery does not include assembly, unboxing, rubbish removal or placement of furniture inside your home.
You are responsible for ensuring your delivery address, contact details and access information are accurate and that the boxed product dimensions are suitable for your building access, including doorways, lifts, stairwells, hallways and parking or loading areas.
If delivery cannot be completed due to incorrect details, missed delivery, unsafe access, no one being available where required, or other access issues, additional delivery or redelivery fees may apply.
If you provide Authority to Leave instructions, the courier may leave your order in a safe place at the delivery address. Authority to Leave is used at your own risk, subject to your rights under Australian Consumer Law.
6. Returns, cancellations and change of mind
Returns and cancellations are governed by our Returns Policy and, where applicable, our 30-Day Comfort Guarantee.
Change-of-mind returns must be requested within 30 days of delivery and are subject to eligibility requirements.
Eligible sofas, accent chairs, ottomans and sofa modules may be covered by our 30-Day Comfort Guarantee. If an eligible furniture item has been unboxed, we ask that you try it for at least 14 days before requesting a return. Approved unboxed returns must be clean, complete, undamaged, in near-new condition and suitable for resale.
For approved unboxed 30-Day Comfort Guarantee returns, a $149 return fee applies if you choose a refund to your original payment method. If you choose store credit, the $149 return fee is waived.
Unopened boxed returns may be accepted within 30 days if the item is completely unopened, unused, in original intact packaging and approved before being returned. The customer is responsible for arranging and paying for return transport for unopened boxed returns.
We do not accept change-of-mind returns after 30 days.
This does not limit your rights under Australian Consumer Law.
7. Damaged, faulty or incorrect items
If your order arrives damaged, faulty or incorrect, please contact us within 48 hours of delivery where possible.
Please email hello@formeliving.com.au with your order number, a description of the issue, clear photos of the packaging, and clear photos or videos of the product and issue.
This helps us assess the matter quickly and work with our delivery partners where needed.
Nothing in this section limits your rights under Australian Consumer Law.
8. Warranty
Our Warranty explains the voluntary warranty coverage that applies to Forme Living Co products.
Forme Living Co offers a 5-Year Limited Warranty for sofas, accent chairs, ottomans and sofa modules.
Smaller accessories, add-ons, removable covers, care items and other non-structural products come with a 1-Year Limited Warranty unless a different warranty period is stated on the product page.
Warranty coverage starts from the date of delivery and applies only to the original purchaser, subject to the terms, eligibility requirements and exclusions in our Warranty.
Our voluntary warranty is provided in addition to your rights under Australian Consumer Law.
9. Australian Consumer Law
Our goods come with guarantees that cannot be excluded under Australian Consumer Law.
You may be entitled to a replacement, refund or compensation where required by law, including where a product has a major failure or fails to be of acceptable quality.
Nothing in these Terms, our Returns Policy, 30-Day Comfort Guarantee, Shipping Policy, Warranty or any other policy limits, excludes or modifies any rights you may have under Australian Consumer Law.
10. Intellectual property
All content on our website, including text, images, graphics, product names, logos, branding, photographs, videos, layout, design, icons and other materials, is owned by or licensed to Forme Living Co and is protected by intellectual property laws.
You may use our website for personal, non-commercial purposes only.
You must not copy, reproduce, modify, distribute, publish, display, sell, resell, exploit, scrape, download, store or transmit any part of our website or content without our prior written permission, except as permitted by law.
The names, logos, product names, designs and slogans associated with Forme Living Co are trademarks or branding owned by or licensed to us. You must not use them without our prior written permission.
11. Third-party services and links
Our website may include links, tools, apps, payment options, embedded features or content provided by third parties.
We are not responsible for the content, accuracy, policies, practices, availability or performance of third-party websites, tools or services.
Your use of third-party websites, tools or services is at your own risk and may be subject to separate terms and privacy policies.
12. Shopify
Our online store is powered by Shopify, which enables us to provide our website and ecommerce services.
Any purchases you make through our store are made directly with Forme Living Co. Shopify is not responsible for any aspect of the sale between you and Forme Living Co, including any product issue, injury, damage, loss, return, refund or warranty claim arising from your purchase.
13. Privacy
Your use of our website and services is also governed by our Privacy Policy.
Because our store is powered by Shopify, some personal information may be collected or processed by Shopify and other service providers to help operate the website, process payments, fulfil orders, provide analytics, prevent fraud and support our business operations.

14. Reviews, feedback and submissions
If you send us reviews, photos, comments, feedback, ideas, suggestions or other submissions, you agree that we may use them to operate, improve, promote and market our business, products and services, subject to applicable law and our Privacy Policy.
You confirm that any content you provide is accurate, lawful, not misleading, and does not infringe another person’s rights.
We may monitor, edit, remove or decline to publish content that we consider unlawful, offensive, misleading, inappropriate, harmful, spam, defamatory, infringing or otherwise unsuitable.
You must not submit false, misleading, abusive, obscene, unlawful or harmful content, or content containing viruses, malware or anything that may affect the operation of our website.
15. Errors, inaccuracies and omissions
Occasionally, information on our website may contain typographical errors, inaccuracies or omissions relating to product descriptions, dimensions, pricing, promotions, offers, shipping charges, delivery timeframes or availability.
We reserve the right to correct errors, inaccuracies or omissions and to update or change information at any time.
If an error affects your order, we will contact you where reasonably possible. We may cancel or amend an order affected by an error, subject to your rights under Australian Consumer Law.

You must not use our website or services:

To the maximum extent permitted by law, our website and services are provided on an “as available” basis.
We do not guarantee that the website will be uninterrupted, secure, error-free or free from viruses or other harmful components.
Any general information provided on our website is for general information purposes only. You are responsible for deciding whether a product is suitable for your home, space, access requirements and intended use.
Nothing in this section excludes, limits or modifies any rights you may have under Australian Consumer Law.
19. Limitation of liability
To the maximum extent permitted by law, Forme Living Co, its directors, officers, employees, contractors, suppliers, service providers and affiliates will not be liable for indirect, incidental, special or consequential loss or damage arising from your use of our website, services or products.
This may include loss of profits, loss of revenue, loss of data, loss of opportunity, loss of use, inconvenience, third-party costs, replacement furniture hire, moving costs, storage costs or similar losses.
Our liability is not excluded or limited where it cannot be excluded or limited by law, including under Australian Consumer Law.
20. Indemnity
You agree to indemnify Forme Living Co against losses, damages, claims, liabilities, costs or expenses arising from your breach of these Terms, your misuse of our website or services, your unlawful conduct, or your violation of another person’s rights.
This indemnity does not apply to the extent caused by our own negligence, breach of law or breach of these Terms.
21. Termination
We may suspend or terminate your access to our website, account or services if we reasonably believe you have breached these Terms, misused our website, engaged in fraudulent or unlawful activity, or created risk for us, our customers, Shopify or our service providers.
Any obligations or rights that by their nature should survive termination will continue, including intellectual property, payment obligations, limitations of liability, indemnities, governing law and any rights or remedies accrued before termination.
22. Severability
If any part of these Terms is found to be unlawful, void or unenforceable, that part will be read down or severed to the extent necessary, and the remaining parts will continue to apply.
23. Waiver
If we do not immediately enforce a right under these Terms, that does not mean we waive that right.
A waiver must be in writing to be effective.
24. Entire agreement
These Terms, together with our Privacy Policy, Shipping Policy, Returns Policy, 30-Day Comfort Guarantee, Warranty and any other policies referenced on our website, form the agreement between you and us regarding your use of our website and purchase of our products.
25. Assignment
You may not transfer, assign or delegate your rights or obligations under these Terms without our prior written consent.
We may transfer, assign or delegate our rights or obligations under these Terms where reasonably necessary for business, operational, legal or restructuring purposes.
26. Governing law
These Terms are governed by the laws of New South Wales, Australia, and applicable Commonwealth laws of Australia.
You and Forme Living Co submit to the non-exclusive jurisdiction of the courts of New South Wales, Australia.
27. Changes to these Terms
We may update or replace these Terms from time to time by posting the updated version on our website.
The updated Terms will apply from the date they are published, unless otherwise stated.
Your continued use of our website or services after changes are posted means you accept the updated Terms.
